Suit for damages for Criminal defamation
Whose image/reputation damaged by someone, may file the petition u/s 200 to the chief metropolitan magistrate to get him punish according to the provision of section 499 r/w section 500 IPC.
Where the accused shall be punished with imprisonment for 2 yrs and fine or with both.
Suit for damages for Civil defamation
A person whose reputation harmed may file a suit for the money to the concern court by paying the appropriate court fee to the court which has the pecuniary as well as territorial jurisdiction.
