Injunction suits

To restrain from the legal rights which one governed a suit for injunction may be filled. It is of two type’s temporary and permanent injunction. The suit for mandatory injunction to some property the possession must be there.

Along with suit an application under order 39 rule 1 & 2 may filled to get temporary injunction often called STAY in a case.

Recovery cases

Recovery cases may classifieds in two category summary suit and ordinary civil suit.

in Summary suit the process is fast more than that of fast track court. On the Other Hand in ordinary civil suit the Process follows little slow.

Suits for recovery of money, by bills and cheques may be filled to recover the debts and liable amount.

Eviction suit

The Hon’ble supreme court of India on many instances says,” if there is bonafide requirement of the landlord then he may get evict his property.  

When someone like tenant or licensee hold your property and you have bonafide need , it is appropriate to get back that property by giving a notice and thereafter by filling a civil suit for eviction in civil court.

Probate of Will

The Probate petition to challenge the will which may made under the influence in whose favor the will is. The will may be probate by presenting the petition to the concern court with help of the legal practitioners.

Declaration of Ownership of Property

Suit for declaration may be filled to the concern district court and Hon’ble High court according to the pecuniary jurisdiction only after due possession and injunction granted by the Hon’ble court.

 These cases are arisen out when there is a dispute in title and possession.

Suit against Ancestral Property / Joint Hindu Property

These are suits under civil procedure code for the partition of the ancestral property. Suits to divide the undivided Hindu joint property and which is forcefully governed by the some other family members by infringing the rights of others.

The main dispute arises when one of the legal heirs tried to grab the entire property.

Suits relating to civil wrongs

Civil wrongs like, someone play sound in non tolerable sound, disturbance, and nuisance against the society. These suits generally may be filled in civil court.

Recovery of Debts

Generally these are the suits relating to credit cards, banks irregularities and the secured debt against the valuable property.

Summary suits

The money suits which are filled under order 37 civil procedure code. It is the boon in the hands of the plaintiff but to file under fulfillment of the requisite condition. The various laws and requirement under the summary trial are explained by the Hon’ble Supreme court in Sunil Enterprises and Anr. v. SBI Commercial and International Bank Ltd

Suit for specific performance

Suits generally related to breach of the agreement are fall under this category. Suits of specific performance may be filled when someone is not obey the terms and condition mentioned in the agreement.

Suit under contract Act or partnership Act

In companies there may be a many kind of disputes which are dealt and sort out by signing contract and Memorandum of understanding. However some of the disputes by one or more person raised which are solved by the Hon’ble court. Like breach of contract, financial crisis, appointment of directors, illegal termination etc.

Various suits fall under this category after the non compliance of the agreement made by the partnership firms and company.
